7.4 Except in respect of death or personal injury caused by edison ford's negligence, edison ford shall have no liability to you for any loss, damage, costs, expenses, or any loss of profit or any indirect, special or consequential loss, damage, costs or expenses or other claims (whether caused by the negligence of edison ford, its servants or agents or otherwise) for compensation arising from your making use of the Site or by reason of any representation (unless fraudulent), or any implied warranty, condition or other term.

Copyright Policy and Indemnity

8.1 We will terminate the privileges of any user who uses this Site unlawfully to transmit copyrighted material without a licence or express consent, valid defence or fair use exemption to do so. 9.2 harasses or advocates harassment of another person;

9.4 promotes information that you know is false, misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;

9.5 promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;

9.6 contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);

9.7 displays pornographic or sexually explicit material of any kind;

9.8 provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18; and

9.9 provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses; solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

Offline Conduct

10 Although edison ford cannot monitor the conduct of its users off the Site, it is also a breach of these Terms to use any information obtained from this Site in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit or sell to any user without their prior explicit consent.

No Commercial Use

11 No area of this Site may be used by visitors for any commercial purposes. You must obtain our prior written consent to make commercial offers of any kind, whether by advertising, solicitations, links, or any other form of communication. Without limiting the foregoing, you may not resell or link to other sites for the purpose of selling services of any kind. Unauthorized Use of the Site

13 Illegal and/or unauthorized uses of the Site, including, but not limited to, unauthorized framing of or linking to the Site, or unauthorized use of any robot, spider or other automated devise on the site, will be investigated and appropriate legal action will be taken, including without limitation civil, criminal and injunctive redress.

Disputes

14 This site is controlled and operated by edison ford from its offices in the United Kingdom. If there is any dispute about or involving the Site, by using the Site you agree that the dispute will be governed and construed by English law. In the event of a dispute arising out of or relating to these terms and conditions, or your use of or access to this site, litigation must be brought in a court in London, England without regard to its conflict of law provisions.

By asking us to quote for, arrange or handle your insurances, you are providing your informed agreement to these Terms of Business. We draw your particular attention to the section headed ‘Use of personal data’ and specifically the paragraph explaining how ‘sensitive personal data’ will be used.

The Financial Services Authority

Edison Ford is a trading name of Ford & Company General Insurance Brokers Ltd which is authorised and regulated by the Financial Services Authority (FSA). Our FSA Register number is 309014.

Our permitted business is introducing, advising, arranging, dealing as agent and assisting in the administration and performance of general insurance contracts. You may check this on the FSA’s register by visiting the FSA website, www.fsa.gov.uk/register/ or by contacting the FSA on 0845 606 1234.

Our Service

Edison Ford is an independent insurance broker and as such acts on your behalf in arranging insurance. Our role is to advise you and, after we have assessed your needs, to make a suitable recommendation. We also offer a service to assist you with any claim you need to make.

In providing our service, we may sometimes act as an agent of the insurer. We will confirm the capacity in which we will act for you before undertaking any relevant transactions on your behalf. If we propose using another intermediary to help place your business, we will confirm this to you in good time before any arrangements are finalised. We will not in any circumstances guarantee the solvency of an insurer.

Personal Insurances                    : We select motor and household products from a range of insurers

Travel Insurances        : We offer travel products from a limited range of insurers. You may ask us for a list of the insurers we deal with for          these products.

Commercial                 : We select commercial insurance products from a range of insurers but, for certain products, we may only deal with a    single insurer or select from a limited number of insurers. You may ask us for a list of the insurers we deal with for these products.

Payment for our Service

We normally receive commission from the insurers or product providers and make charges for handling your insurances as follows:

Cancellation at your request                                   £20.00 or 15% of the first premium (whichever is the greater)

Cancellation due to non payment of policy           £50.00

In good time before the conclusion of each insurance contract, or upon renewal, we will remind you of your right to be informed of the level of commission which we receive from underwriters. You are entitled, at any time, to request information regarding any commission which we may have received as a result of placing your insurance business.

You will receive a quotation which will tell you the total price to be paid, showing any fees, taxes and charges separately from the premium, before your insurance arrangements are completed.

We normally accept payment by Cash, Guaranteed Cheque, Mastercard, Visa or Debit Cards.

We also draw your attention to the sections headed ‘Cancellation of Insurances’ and ‘Ending your relationship with us’.

Handling Money

Our financial arrangements with most insurance companies are on a ‘Risk Transfer’ basis. This means that we act as agents of the insurer in collecting premiums and handling refunds due to clients. In these circumstances such monies are deemed to be held by the insurer(s) with which your insurance is arranged. However, if Risk Transfer does not apply, such monies will be held by us in a Statutory Trust account set up in accordance with FSA rules. Interest earned on monies held in such a Statutory Trust account will be retained by us. For the purpose of some transactions, client money may pass through other authorised intermediaries before being paid to the insurer.

Credit Check

To make sure you get the best offer from insurers, now or at any renewal or at any time and to protect their customers from fraud and to verify your identity, they may use publicly available data which they obtain from a variety of sources, including a credit reference agency and other external organisations. Their search will appear on your credit report whether or not your applications proceed.

As well as these searches, insurance companies may use a credit check to ascertain the most appropriate payment options for you. This credit check will also appear on your credit report whether or not your applications proceed.

Cancellation of insurances

You should make any request for the cancellation of the policy in writing and any relevant certificate should be returned to us or to the insurer concerned. In the event of cancellation, charges for our services will apply in accordance with the service charges listed above. The terms of your policy may allow insurers to retain the premium in full or to charge short period premiums in the event of cancellation.

Ending your relationship with us

Subject to your immediate settlement of any outstanding premiums and fees, you may instruct us to stop acting for you and we will not impose a penalty.

Your instructions must be given in writing and will take effect from the date of receipt.

In circumstances where we feel we cannot continue providing services to you, we will give you a minimum of 7 days notice.

Unless otherwise agreed in writing, if our relationship ends, any transactions previously initiated will be completed according to these Terms of Business. You will be liable to pay for any transactions concluded prior to the end of our relationship and we will be entitled to retain commission received for conducting these transactions, together with all fees charged by us for services provided.

Direct debit/credit scheme arrangements

You may be able to spread your payments through an insurer’s instalment scheme or a credit scheme arranged via ourselves through a preferred supplier. We will give you information about your payment options when we discuss your insurance in detail.

We may keep certain documents such as your insurance certificate while we are awaiting the full payment of premium (or evidence of no claim discount unless the gross premium is paid).

Your responsibilities

You are responsible for providing the complete and accurate information which insurers require in connection with any proposal for insurance cover. This is particularly important before taking out a policy and at renewal, but it also applies throughout the life of a policy. If you fail to disclose information, or misrepresent any fact which may influence the insurer’s decision to accept the risk or the terms offered, this could invalidate the policy and mean that claims may not be paid. You must check all details on any proposal form or Statement of Facts and pay particular attention to any declaration you may be asked to sign.

It is important that you read all insurance documents issued to you and ensure that you are aware of the cover, limits and other terms that apply. Particular attention must be paid to any warranties and conditions as failure to comply with them could invalidate your policy.

You must inform us immediately of any changes in circumstances which may affect the services provided by us or the cover provided by your policy.

NOTE: Insurers pass information to the Claims and Underwriting Exchange run by Insurance Database Services Limited and the Motor Insurance Anti-Fraud and Theft Register run by the Association of British Insurers. The aim is to check information provided and also prevent fraudulent claims. In the event of a claim or accident the Database may be used by Insurers Bureau to identify relevant policy information.

Complaints and compensation

It is our intention to provide you with a high level of customer service at all times. However, there may be occasions when you feel this objective has not been achieved and you feel that you should lodge a formal complaint, we have a formal complaints procedure. In the first instance you should write to us at Edison Ford, Unit 1, Armstrong Way, Great Western Business Park, Yate, South Glos. BS37 5NG quoting your policy number, Broker Reference or Claim Number if appropriate.

Your insurer also operates a complaints procedure, details of which are in your policy. If you are still not satisfied, you may be entitled to refer the matter to the Financial Ombudsman Service.

Access to the FOS is available for complainants coming within one of the following categories at the time we receive their complaint:

·          business employing fewer than 10 persons and with a turnover or annual balance sheet total not exceeding £2million

·          charities with an annual income of under £1million

·          trustees of a trust with a net asset value of under £1million

We are covered by the Financial Services Compensation Scheme (FSCS). You may be entitled to compensation from the scheme if we cannot meet our obligations. This depends on the type of insurance, size of the business (if a commercial customer) and the circumstances of the claim. Further information about compensation scheme arrangements is available from the FSCS on 0207 892 7300 or www.fscs.org.uk

Use of personal data

We will process any personal information we obtain in the course of providing our services to you in accordance with the Data Protection Act 1998. In administering your insurances it will be necessary for us to pass such information to insurers and other product or services providers which may also provide us with business and compliance support.

You may also disclose details to relevant parties, as necessary, to comply with regulatory or legal requirements. We may contact you or pass your details to other companies associated with us in order to promote products or services which may be of interest to you. We will not otherwise use or disclose the personal information we hold without your consent.

Some of the details you may be asked to give us, such as information about offences or medical conditions, are defined by the Act as sensitive personal data. By giving us such information, you signify your consent to its being processed by us in arranging and administering your insurances.

Subject to certain exceptions, you will be entitled to have access to your personal and sensitive personal data for which you will be charged a fee of £10. If at any time you wish us, or any company associated with us, to cease processing any of the personal data or sensitive personal data we hold, or to cease contacting you about products and services, please write to the address on the front page of this Terms of Business.

Records

We keep records of all our business transactions for at least 6 years, and policy information for 3 years. You may inspect information relating to you, whether kept manually or electronically. We treat all our client records as confidential, so we reserve the right to give you copies of your particular records rather than access all files containing records of other clients.

Conflict of interest

Occasions can arise where we or one of our associated companies, clients or product provider may have a potential conflict of interest with business being transacted for you. If this happens and we become aware that a potential conflict exists, we will write to you and obtain your consent before we carry out your instructions, and detail the steps we will take to ensure fair treatment.

Claims handling arrangements

You should take note of the required procedures in the event of a claim, which will be explained in the policy documentation. Generally, insurers require immediate notification of a claim or circumstances which might lead to a claim. We will employ due care and skill if we act on your behalf in respect of a claim.
